Trump Revokes Emergency Abortion Guidance

The Trump administration has rescinded a Biden-era policy that instructed hospitals to provide emergency abortions when necessary to stabilize patients, even in states where abortion is banned or heavily restricted.
Why Biden Issued the Policy- and Why Trump Is Revoking It
Originally issued in 2022 after the fall of Roe v. Wade, the guidance cited the Emergency Medical Treatment and Labor Act (EMTALA), which requires Medicare-funded hospitals to offer stabilizing care to all emergency patients - including abortion if needed to prevent serious complications such as hemorrhage or organ failure. The Trump administration said Tuesday that it will continue to enforce EMTALA but argued Biden's interpretation created legal instability. The Centers for Medicare & Medicaid Services said it would work to “rectify any perceived legal confusion” left by the prior policy. (ABC News)
Critics Say Pregnant Patients Could be Left in Danger
Medical associations and abortion rights groups blasted the decision. Dr. Jamila Perritt, president of Physicians for Reproductive Health, said the action “sends a clear message: the lives and health of pregnant people are not worth protecting.” (Guardian)
Nancy Northup of the Center for Reproductive Rights echoed that concern, warning the move could worsen confusion at hospitals and result in care being denied during pregnancy emergencies. (AP)

Supporters of the policy change argue the Biden-era rule blurred legal lines.
Marjorie Dannenfelser, president of SBA Pro-Life America, said “Democrats have created confusion on this fact to justify their extremely unpopular agenda for all-trimester abortion. In situations where every minute counts, their lies lead to delayed care and put women in needless, unacceptable danger.” (AP)
